Terms & Conditions Last updated: 20th October 2025 These Terms and Conditions (“Terms”) govern your use of the website www.miliberry.com (the “Site”) and your purchase of products from Miliberry (“we”, “us”, “our”), which offers print-on-demand products fulfilled by Printify and payments via Stripe. By accessing or using the Site, placing an order, or otherwise interacting with us, you agree to these Terms. 1. Scope & Legal Framework These Terms apply when consumers (private persons or companies) purchase goods from us. For business customers, certain provisions may differ. Consumer Rights: You have rights under Austrian law and EU law (especially the EU Consumer Rights Directive) regarding cooling-off/cancellation, mandatory information, and withdrawal rights. 3. Contract Formation When you place an order via the Site and payment is confirmed, a contract is formed between you and Miliberry. Orders are confirmed once payment is processed. Before ordering, you will be shown product description, price (including VAT and shipping), delivery times, and payment methods. 3.1 Eligibility and Age Requirement By using this website and placing an order, you confirm that you are at least 18 years old or the age of majority in your country of residence, and that you have full legal capacity to enter into a binding contract. If you are under 18, you may only use our website with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. 3.2 Children’s Privacy Our website is not directed at children under the age of 16. We do not knowingly collect or process personal data from anyone under this age. Austria follows the GDPR Article 8(1) default rule of age 16 for valid consent. If you are a parent or guardian and believe your child has provided us with personal data, please contact us at support@miliberry.com and we will promptly delete such information. By placing an order in our website you confirm that you are at least 18 years old or the age of majority in your country of residence and agree to the Terms & Conditions and Privacy Policy. 4. Products, Fulfilment & Printify All products are custom printed on demand via our partner Printify. Production and shipping are done by Printify or its network of print providers. Slight variations in color, print placement, or size are normal and not defects. Please also consult our design-guide. Production/shipping delays may occur due to Printify or carriers. Because products are made to order, they may have slight variations in color, size, print alignment. 5. Prices, Currency & VAT All prices are shown in EUR (unless otherwise indicated) and include Austrian VAT (if applicable). If you are located in another EU country, the VAT rate charged will be the local rate applicable to your delivery address. For cross-border EU sales, we may use the One Stop Shop (OSS) scheme to collect VAT. If you provide a valid EU VAT number (for B2B transactions), different VAT treatment may apply (e.g., 0% VAT), subject to verification. For B2B orders with valid EU VAT numbers, VAT may be exempt. 6. Payment Terms Payments are securely processed via Stripe, Inc. You agree to Stripe’s Terms of Service and Privacy Policy. We do not store full credit/debit card details. Stripe handles payment processing and security. Stripe uses industry-standard encryption and PCI DSS-compliant security to protect your payment information. Payment is taken at the time the order is placed. If payment fails (e.g. card declined), the order will not be accepted. All payments are processed securely by Stripe. We do not store or have access to your complete credit card information. Stripe collects and processes payment information in accordance with applicable data protection laws. You authorise us and Stripe to charge your designated payment method for the total amount of your order, including any applicable taxes or fees. If your payment is declined or fails to process, your order or service may be suspended or cancelled. Payment is due before dispatch (or as agreed). Refunds, if applicable, will be issued according to our refund policy and processed through Stripe or Printify to the original payment method or depending on currency otherwise stated by Printify. All payments are processed in EUR and include applicable taxes as specified. Stripe uses industry-standard encryption and PCI DSS-compliant security to protect your payment information. All payments on our website are processed securely through Stripe, Inc. (“Stripe”). By purchasing any products from our store, you agree to be bound by Stripe’s Terms of Service and Privacy Policy. We accept major credit and debit cards, and other payment methods as offered by Stripe. When you provide your payment information, it is transmitted directly to Stripe via a secure connection. We do not store, process, or have access to your full payment card details. Your payment method will be charged at the time of purchase. If payment is declined, your order will not be processed. Stripe may collect and process certain personal data as necessary to complete the transaction and prevent fraud, in accordance with its own privacy policies. All prices listed on our website are in EUR and include applicable taxes as indicated. If your bank or card issuer operates in a different currency, conversion rates and fees may apply according to their policies. 7. Delivery, Shipping, Title & Risk Shipping times and costs are estimated and shown at checkout. These are estimates; actual delivery can vary, especially for international orders. Risk and title transfer to you when the product is handed over to the shipping carrier. 8. Right of Withdrawal (for Consumers in EU / Austria) Under EU and Austrian law, consumers have a 14-day right of withdrawal (cooling-off period) on most goods purchased online, unless the item is made to order/customised (which may be exempt). Because our products are custom-printed on demand, the right of withdrawal does not apply to products which are made according to your specifications or clearly personalised which is the case for all products that appear on the website. Custom-made/personalized products are exempt from the 14-day EU/Austrian withdrawal right. 9. Defective or Damaged Goods or Faulty Goods/ Warranty If products are defective, damaged, or incorrect, please contact us within 7 days of receipt, with photos or evidence. We will offer a refund or replacement at our discretion if that damage is on us. If your item arrives damaged or with a manufacturing issue, we’ll happily offer a free reprint or refund. Just contact us within 7 days of delivery with a photo showing the issue and measurement of the size of the damage with a ruler placed in the photo also so we can see it clearly. There’s no need to return the item in this case. Miliberry ethical statement – We want you to love what you ordered! If there’s a problem with your item (wrong print, damaged, manufacturing issues etc.), please contact us within 7 days and we’ll fix it. No need to send it back. Ordered the wrong size or color? While we can’t offer a full refund in this situation, we’re happy to provide a one-time discount on a replacement. For more questions, reach out anytime through our Contact Form. We’re here to help. We take great care to ensure your products arrive in excellent condition. If your order arrives damaged, defective, or incorrect, please contact us within 7 days of delivery at support@miliberry.com, providing your order number and clear photos of the issue. Products may show minor variations in color or placement due to the print-on-demand process; such differences are not considered defects. All Miliberry products include specific care and washing instructions to help preserve print quality and fabric integrity. Damage or fading resulting from failure to follow these instructions (e.g., washing at incorrect temperatures, using bleach, ironing over prints, or tumble drying when prohibited) is not considered a manufacturing defect and is not eligible for a refund or replacement. 9.1 Product Care Instructions To keep your Miliberry products looking their best: Turn garments inside out before washing. Wash cold (max 30°C / 86°F) with similar colours. Use mild detergent, no bleach. Do not tumble dry. Hang or lay flat to dry. Do not iron directly over prints. Do not dry clean. Failure to follow these care instructions may result in fading, cracking, or shrinkage, which are not covered under our refund or replacement policy. 10. Returns, Refunds & Cancellations Orders can only be cancelled before production begins. Once Printify starts printing/shipping, cancellation is no longer possible. Refunds will be processed via Stripe or Printify to the original payment method. Please allow 5–10 business days for the refund to appear. 11. Intellectual Property All designs, text, graphics, logos, images on the Site are owned by Miliberry or its licensors and protected under copyright, trademark law, etc. You may not copy, reproduce, distribute, or modify our intellectual property without express written consent. All Miliberry content is protected by IP law. 11.1 Intellectual Property and Customer-Uploaded Content Ownership and Responsibility By uploading any design, photo, artwork, or other content to our website for printing or use on products (“Customer Content”), you represent and warrant that: You are the creator of the content or have obtained all necessary rights, licenses, consents, and permissions to use it; The content does not infringe any intellectual property, privacy, publicity, or other rights of any third party; The content complies with applicable laws and does not include illegal, offensive, or inappropriate material. License to Miliberry – By submitting Customer Content, you grant Miliberry a limited, non-exclusive, royalty-free license to use, reproduce, and display the content for the purpose of fulfilling your order and promoting our services (e.g., displaying mockups of your product on the Site or in marketing). Liability – You agree to indemnify and hold harmless Miliberry, Printify, and their partners from any claims, damages, or expenses arising out of your Customer Content, including claims of copyright, trademark, or other legal violations. Right to Remove or Reject – Miliberry reserves the right to refuse, remove, or cancel any order or content that we deem, at our sole discretion, to violate laws, rights of third parties, or our policies, without prior notice. Liability & Limitation of Liability To the maximum extent permitted by law, Miliberry is not liable for indirect or consequential losses. Our liability for defect or non-conformity is limited to repair, replacement, or refund of the product in accordance with Austrian and EU consumer law Limited to replacement, repair, or refund under Austrian/EU law. No liability for indirect/consequential damages. 13. Data Protection & Privacy Personal data collection, processing and storage are governed by our Privacy Policy. 14. Governing Law & Jurisdiction These Terms are governed by the laws of Austria. For consumers resident in Austria, the competent courts of Austria shall have jurisdiction. For consumers resident elsewhere in the EU, jurisdiction rules under EU regulations apply Courts in Austria have jurisdiction for Austrian residents; EU regulations for cross-border consumers. 15. Severability If any provision of these Terms is invalid or unenforceable, the remaining Terms remain in force. 2. Refund Policy Last updated: 20th October 2025 This Refund Policy governs how we handle refunds, returns, and cancellations for orders placed at Miliberry (Austria / EU), for custom print-on-demand products fulfilled via Printify. 1. Exemptions & Custom Products Because our products are custom-made / personalized on demand, they are exempt from the 14-day EU/Austrian withdrawal right (for customization). 2. Defective, Damaged or Incorrect Items If your item arrives defective, damaged, or not as ordered, please contact support@miliberry.com within 7 calendar days of receipt. Please include order number, photos of the defect/damage or wrong item. We will (at your choice) either replace the item free of charge, issue a full refund, or provide partial refund if applicable. 3. Non-Defective, Custom Items We do not accept returns or issue refunds for change of mind, wrong size or wrong colour (unless misleading size guides, or we are proven at fault), or buyer errors, for custom-printed items. 4. Cancellation You may cancel your order before it is sent to Printify for production. Once production has begun, cancellation is not possible. Cancellations possible only before production. 5. Refund Processing All approved refunds are processed via Stripe or Printify to the original payment method. Refunds will be initiated within 5–10 business days after approval of your request. It may take additional time for your bank or card issuer to post the refund. 6. Shipping Costs Unless the return is due to our fault (damaged, defective, incorrect item), return shipping costs are borne by you. Shipping costs for returns are customer’s responsibility unless due to our error. 3. Shipping Policy – Miliberry Last updated: 20th October 2025 Website: www.miliberry.com 1. Fulfilment and Processing All Miliberry products are made to order through our print-on-demand partner Printify. We start producing your item as soon as payment is confirmed via Stripe. Fulfillment time: usually 2–7 business days (depending on product type and production volume). During busy seasons or high demand, processing may take slightly longer. You will receive a shipping confirmation email with tracking information once your order has been dispatched. 2. Shipping Destinations We currently ship to most countries worldwide. Please note: Some regions may have limited delivery options depending on Printify’s production partners. Orders cannot be shipped to PO boxes, military addresses (APO/FPO), or countries under international shipping restrictions. 3. Shipping Rates and Delivery Times Shipping costs are calculated at checkout based on destination, product type, and quantity. Actual times may vary due to customs processing, postal delays, or carrier issues beyond our control. 4. Tracking All orders include a tracking link once shipped. Please allow up to 48 hours after receiving your shipping confirmation for tracking data to update. 5. Customs, Duties, and Taxes Orders shipped outside the European Union may be subject to customs fees, import duties, or taxes imposed by the destination country. These charges are not included in our prices and are the customer’s responsibility. Miliberry cannot predict or control these charges and is not liable for delays caused by customs. 6. Incorrect or Incomplete Addresses Please ensure your shipping address is accurate and complete at checkout. We cannot refund or replace orders that are: Undeliverable due to incorrect or incomplete addresses, or Refused or unclaimed by the recipient. If the package is returned to us, we may reship it at your expense. 7. Lost or Delayed Shipments If your tracking shows no movement for more than 15 business days, or if the order appears lost in transit, please contact support@miliberry.com with your order number. We will open an inquiry with Printify and the carrier. We cannot be held responsible for delays due to: Customs inspections, Incorrect addresses provided by the customer, Natural disasters or other events outside our control. 8. Multiple Shipments To speed up delivery, items in your order may be shipped separately from different production partners (especially for multi-product orders). You will receive a tracking link for each parcel. 9. Damaged Goods If your package arrives damaged, please report it within 7 calendar days of delivery by emailing support@miliberry.com with: Order number, Photos of the damaged item and packaging. We will assess the issue and offer a replacement or refund in accordance with our Refund Policy. Damage resulting from mishandling after delivery or not following product care instructions (e.g., improper washing, bleaching, tumble drying) is not covered. 10. Responsibility and Ownership Risk of loss or damage passes to the customer upon delivery to the shipping carrier. If tracking confirms delivery but you have not received your package, please contact the carrier directly for assistance. 11.
